By using this website, you acknowledge and agree that access to, use of, and any purchases made on this website are all subject to the terms and conditions set forth in this legal notice and any and all other applicable laws, including the laws of the United Kingdom. Persodias.co.uk reserves the right to update or modify any of the Terms and Conditions, as well as any policy and/or directive of the Site, at any time.
PRODUCT DISPLAY
All images and visual representations of the products displayed at Persodias websites and other online platforms are utilized on the website to reflect the most accurate representation of the actual products therefore may not represent the actual size, colour of the product. Depending on the devices products viewed, such as; mobile devices, laptops, tablets, and monitors, digital representation of Persodias’ product details and features might vary in terms of their color, size, texture, measurement, weights or other details. Persodias, therefore, reserves the right to reject any liability or responsibility that might be caused due to these differences or the temporary or final unavailability of the products on the website that might occur while viewing Persodias products on digital platforms.
Due to each gemstone’s unique nature and properties such as its carat weights, those properties are displayed as approximate and may vary significantly on the website, order confirmation email, or in other forms of communication you might receive from Persodias. Normally, the carat weight of the gemstones utilized in products should exceed the approximate weight. If that is not the case and if the gemstone carat is considerably lower than the displayed approximate weight, Persodias, of their own accord, may issue a refund for the difference in carat weights to your initial method of payment.
Persodias sends Authencity Certificates with all of the orders customers place. These certificates can be issues by third party laboratories or GIA or Persodias’s Gemologists.
If you demand your jewelry to be certified by a different gemology laboratory, this cannot be fulfilled or managed by Persodias depending on their sole discretion. If the request is entertained by Persodias, shipment and delivery times can vary.
If you are not happy with the item you purchased, you can exchange, or return the product within 30 days of its delivery under the 30-day Warranty Policy. Please refer to our Return Policy for more details.
SHIPMENTS
Persodias strives for excellence in delivery times. Having said this, and although Persodias works with very reputed delivery partners (FedEx, UPS, DHL, Brinks, etcetera), Persodias can only control the ‘in-time’ shipment of a package. A delay in delivery can always happen and is therefore beyond our control. No company in the world can guarantee 100% in-time delivery. This is simply impossible as we always rely on people, regulations, and governmental decisions, and therefore force majeure can always happen, i.e. and in a non-restricted way is understood by force majeure, war, revolution, attempts, disasters, strikes, epidemics, pandemics, local and cross-border government measures and all other events beyond Persodias will and control by which Persodias cannot partially or totally fulfill their obligations anymore and consequently does not grant the client any right for financial compensation or cancellation of the order. Consequently, a late delivery as such does not grant the client any right to financial compensation or cancellation of the order. If Persodias is unable to deliver on time, Persodias will inform the customer as soon as possible and agree on a new delivery date that is reasonable under the circumstances.
There might e several occasions for which you prefer Persodias such as weddings, anniversaries, birthdays, engagements or any other special occasions but not limited to those listed. Persodias shows utmost efforts to make sure your items are delivered on time however potential delays might occur during shipment. By purchasing our products, you accept any possible delays that might occur on your delivery and that you will not hold Persodias accountable for such delays.
RETURNS
All customers are eligible for free return if the product is returned within 30 days of its purchase.
Products should be returned:
Undamaged,
Unused,
Without any resizing or modification
Without showing any signs of damage and wear,
With original security tag, packaging and certificate intact,
Please keep in mind that products with GIA certificates cannot be returned.
Once the items sent by the customer are checked by Persodias, approval of the return can take 15 business days. If the customer has placed multiple orders, please mind that only the latest order can be returned within 30 days of its delivery.
After detailed checking, Perdodias reserves the right to reject any item if the item has been used, damaged or has any defect. Any such rejected item will be returned back to the member to his own cost.
REFUNDS
Persodias sends all orders with their individual boxes and their PD certificates. If you received your item and you are unhappy about it, you can return the item the way you received it within 30 days of its delivery. All items must be sent with their relevant packaging, documentation, security tags and gifts if applicable without any damage, tear, or signs of wear. Once the return request is approved by Persodias, customers will receive a full refund.
In some cases due to some extra charges, you should check with local authorities prior to placing your order as international customers are responsible for any duties, VAT taxes, or surcharges imposed or assessed by the country.
Persodias will never be responsible for any mistakes coming from the customer’s side (ex. erroneous bank details) that would result in bank fees. The customer will eventually be charged for these bank fees.
Persodias will never take on its behalf any bank fees which result out of the bank wire. These bank fees will eventually be on behalf of the customer.
CANCELLATION OF ORDERS
Persodias reserves the right to cancel the order once the delivery is placed by the customer. Persodias will process a full refund to your initial method of payment. The reasons for order cancellations may be due to the below circumstances however it can not be limited to those only;
1. If there is a pricing error on the item purchased
2. If the payment has been made in an unauthorized, illegal, or fradulent way
3. Due to any errors that might occur on product, pricing, and website
4. If the item parts of the item such as the gemstones in question are out of stock
5. Manufacturer-related faults and issues
6. Payment issues such as incomplete payment
7. If there are any logistics issues
8. Shipment and delivery-related issues
9. Difficulties in indelivery processes
OBLIGATIONS AND LIABILITY
USE OF SYSTEMS/CONNECTION
Persodias waives any liability for damages caused by dysfunctions of the hardware and/or of the software systems and all devices referred to these systems, which are used to have access to the website of Persodias.
SECURITY AND PRECAUTIONS
The client is obliged to notify Persodias immediately of all problems related to the access and use of the Persodias website.
By purchasing from Persodias, you hereby accept that you will not hold Persodias accountable for any payment-related issues such as exceeding your card limit, or credit limit, experiencing overdraft charges, exchange rates, and losses, payments, damages, or payment declines for any transactions you are making that is not limited to these processes listed in this section.
You hereby accept that Persodias rejects any responsibility if there is a breach of the guarantee (damage, misuse, etc.) of the product or the Policy and these Terms & Conditions.
You hereby accept that you will not hold Persodias accountable for any product damage, modifications
defects or service inconveniences that could be brought upon by third parties.
You agree that Persodias will not be accountable for any harm or damage as a result of a breach of terms and guarantees such as death, financial loss, or personal injury.
If Persodias is held liable for any reason, the liability will only be limited to the amount of the order in question.
You are obliged to comply with all relevant and applicable legislations, regulations, laws, jurisdictions and custom declarations, export and import permits if you are purchasing any item from Persodias. Before purchasing your item, you need to make sure the item is nationally allowed for shipment and usage within your region. You accept that Persodias will not be liable for any issues in relation to import, export, customs, and other legal regulations and fines, fees or penalties as a result of legal matters listed above and the ones that may not have been mentioned here.
UNAVAILABILITY OF THE STOCK
Persodias always puts the quality of jewelry displayed on any Persodias platform first. Under certain circumstances, the availability of certain products can be limited due to external reasons beyond Persodias’ control. Persodias makes sure the out-of-stock are always kept updated on online/digital platforms to reflect the right stock information for their customers however on rare occasions, out-of-stock products can be displayed on online/digital platforms for a brief period of time. If you happen to revisit our website or digital platforms you might not find the same product available as the stock will be updated. That means the product is currently out of stock or unavailable.
PRICES AND PAYMENTS
Persodias reserves the right to make any changes to the pricing of the items.
Persodias takes the payment as soon as the order is placed and verifies the bank details in a secure way for security purposes.
Widely known and used cards such as; Amex, Mastercard, Visa and Discovery are accepted while making payments at Persodias.
Prices of the items include certification, and packaging unless it is stated otherwise. Sales tax will separately be shown on the payment screen.
The shipment process only begins after the order is placed and payment is fully progressed.
DISCLAIMERS
To the fullest extent permitted by 'law', Persodias provides this website on an "AS IS" basis and makes no warranty of any kind, either express or implied, with respect to this website or its contents. You agree to use persodias.co.uk at your own risk.
By accepting this, you agree to release Persodias from any liability for any direct, special, incidental, consequential, indirect, or punitive damages, whether in an action under contract, or negligence, arising from or in connection with your access, use, or inability to use this website or errors or omission in the content thereof. As Persodias, we reserve the right to change any information, price, or content and improvise the website at any time without notice.
We are not liable for any losses if the products are harmed or corroded as a result of collisions with or friction with hard objects, wearing the jewellery while bathing or in hot springs, etc.
Additionally, our 30-day return policy will not apply to the aforementioned behaviors.
Persodias also will not be responsible for any losses if packages are lost because customers provided incorrect shipping addresses. There won't be a refund offered in this circumstance.
COMPARISON PURCHASING
All jewelry personalised by Persodias are hand crafted once they are ordered. Therefore Persodias does not allow purchase of multiple items for comparison purposes. This is also applicable to any variations in gemstones and their weight, carat, measurements, metal, size and etc. If you have queries about a particular item you are interested in, please contact us via email and Persodias team would be happy to assist you.
Persodias reserves the right to cancel any order that might be of lower value and orders including multiple items.
SEVERABILITY
If any part, term or provision of this Agreement is held to be illegal, in conflict with any law, or otherwise invalid, the remaining portion or portions shall be considered severable and not be affected by such determination, and the rights and obligations of the parties shall be construed and enforced as if the Agreement did not contain the particular part, term or provisions held to be illegal or invalid.
JURISDICTION
The terms and conditions specified on this Website shall in all respects be governed and construed by English law. The parties hereby irrevocably submit to the nonexclusive jurisdiction of the English courts.
